Confindustria ANCMA (National Association of Cycle Motorcycle Accessories) intervenes following the news reported by some press bodies, according to which the Council of Ministers during the meeting of 3 August approved a draft legislative decree for the transposition of EU directive 2021/2118, which would extend the third party liability insurance obligation to bicycles.
In our article we had mentioned the fact that 'traditional' bikes and classic e-bikes are not affected. Now ANCMA comes with confirmation.

In a note, the association underlines that “from reading the directive it clearly emerges that the provision concerns vehicles driven exclusively by a mechanical force, therefore by an engine. As entered into the Council of Ministers, the draft of the implementing decree does not refer to any insurance obligation for pedal assisted bicycles, nor even for muscle bicycles - whose functioning is primarily determined by the action of assisted muscle strength in the case of e-bikes by a mechanical force that always stops in the absence of the first one - and expressly confirms the exclusion of these vehicles from the purposes of the directive itself".
In the light of these clarifications, ANCMA underlines again that “even just the short-sighted prospect of e-bike insurance, the obligation of which is not present in any European state, represents a factor of great concern for a driving sector and for a market that only last year generated a volume of business of over 3,2 billion euros".
